These Terms of Use govern the use of the website, the application, and the 2TK / To The Key services, operated by To The Key ("2TK", "we", "the service").
By using the service, creating an account, or accepting these terms, the user confirms that they have read the terms and the Privacy Policy and that they agree to them.
If you do not agree to the terms, do not use the service.
1. What is 2TK
2TK is a technology platform intended to enable property publishers and housing seekers to find one another, present and view properties, express interest, create a mutual Match, and communicate within the platform.
Unless expressly stated otherwise with respect to a particular service, 2TK is not the property owner, is not the tenant, is not a party to a rental agreement, is not the property's management company, does not provide legal, financial, or appraisal advice, and does not guarantee that a transaction will be completed.
Information in the service should not be regarded as a recommendation or promise with respect to a user, a property, a price, the merit of a transaction, or legal suitability.
2. Eligibility to use
The service is intended for those aged 18 and over who are competent to enter into a binding agreement.
The user undertakes to provide accurate, current, and complete information and not to impersonate another person.
3. User account
Each user is responsible for safeguarding the means of access to their account and for any action taken through it, unless they have notified 2TK of unauthorized use.
You may not transfer your account to another person, sell an account, or create fake accounts.
2TK may require additional verification where there is a security or operational justification.
4. Identity verification
Certain actions may be conditioned on completing KYC or identity verification.
Verification may include an identity document, a photo, a selfie, or other checks presented to the user during the process.
Identity verification is intended to reduce impersonation and fraud, but is not an absolute guarantee of a user's identity, reliability, financial capacity, or conduct.
2TK does not guarantee that a verification process will prevent any impersonation or abuse.
5. Property publishers
A publisher undertakes that they hold the legal right to publish the property or act under appropriate authorization on behalf of the rights holder.
The publisher is responsible for the accuracy, legality, and currency of the listing details, including photos, address, price, features, availability, and description.
You may not publish a property that is not available for rent, a misleading listing, false information, photos the publisher has no right to use, or content that infringes the law or third-party rights.
When a property has been rented, removed, or is no longer available, the publisher must update the status promptly.
6. Renters and housing seekers
A renter is responsible for the accuracy of the information they present in their profile and for fair use of the service.
Expressing an Interest or Like does not create a rental agreement, an undertaking by the publisher, or a right to receive the property.
7. Interest and Match
An Interest by a renter expresses interest in a property only.
A Match is created only when the conditions required in the service are met, including a valid mutual interest.
A Match does not constitute approval of a rental, an agreement, an undertaking, a credit approval, a recommendation, or a promise on the part of 2TK.
8. Communication and chat
Access to chat between the parties is enabled only in accordance with the Match and service rules.
For privacy and safety reasons, the service may restrict the sending or exposure of phone numbers, email addresses, links, photos, or other contact details until the appropriate authorization stage is completed.
You may not attempt to circumvent these restrictions by technical means, disguised spelling, images, links, or any other manner.
2TK may operate automated mechanisms to detect or block content suspected of being an attempt to circumvent the privacy and safety rules.
9. Meetings and property viewings
Scheduling a meeting or viewing is not an undertaking by 2TK and does not guarantee that either party will attend, that the property will be suitable, or that a transaction will be signed.
Users are responsible for taking reasonable precautions when meeting a person they do not know.
10. User content
The user remains the rights holder in content they upload, subject to third-party rights.
For the purpose of operating the service, the user grants 2TK a non-exclusive license, limited to the purposes of the service, to store, process, display, reformat, technically transmit, and make the content accessible in accordance with the actions requested by the user and the features of the service.
This license does not transfer ownership of the content to 2TK.
The user undertakes not to upload content they are not entitled to use.
11. Prohibited use
The service may not be used for fraud, impersonation, harassment, threats, harm, prohibited discrimination, spam, misleading advertising, data mining, scraping, intrusion attempts, circumvention of security controls, creation of automated accounts, use of the service's components contrary to permissions, or any other unlawful activity.
Information about other users may not be collected outside the ordinary purpose of using the service.
12. Blocking, reporting, and enforcement
Users may use the blocking and reporting tools available in the service.
2TK may review reports, restrict an action, remove content, suspend an account, or close an account in the event of a breach of the terms, a suspicion of fraud, a safety risk, a breach of law, or a need to protect the service or its users.
13. Third-party services
Part of the service may rely on Google, Apple, KYC providers, map services, Push notifications, hosting, storage, and other technical services.
Use of third-party services may also be subject to their terms and policies.
2TK does not control the availability of a third-party service and does not guarantee that such a service will operate without interruption.
14. Payments and commissions
As of the date these terms were updated, a Match, chat, or scheduling a meeting shall not, in themselves, be regarded as consent to a monetary charge, unless separate payment terms are expressly presented to the user and they approve them.
If payment, deposit, charge, commission, or other commercial services are activated in the future, they will be subject to additional terms presented before the charge is made.
No charge or commission may be applied by virtue of this section alone.
15. 2TK intellectual property
The brand, logo, software, code, design, interface structure, texts, and content of 2TK that are not user content are the property of 2TK or of the relevant rights holders.
You may not copy, modify, distribute, reverse engineer, or make unauthorized commercial use of the service's assets, except as expressly permitted by law.
16. Service availability
We work to maintain the availability of the service, but we do not guarantee continuous, fault-free, or always-available operation.
There may be maintenance work, malfunctions, changes, temporary blocks, or discontinuation of features.
17. No undertaking with respect to users and properties
2TK does not guarantee the accuracy of any information uploaded by a user, the legal or physical condition of a property, a user's financial capacity, the outcome of an identity check, a rental agreement, or a user's conduct outside the service.
The user must carry out the necessary checks themselves before entering into a transaction.
18. Limitation of liability
To the maximum extent permitted by law, 2TK shall not be liable for indirect or consequential damage, loss of profit, loss of opportunity, or damage arising from an engagement between users, from information uploaded by another user, or from activity outside 2TK's control.
Nothing in these terms derogates from a right or liability that cannot be conditioned upon under the law.
19. Indemnification
Subject to the law, a user who caused damage to 2TK or to a third party as a result of a breach of these terms, a breach of law, or a breach of third-party rights may be required to indemnify 2TK for reasonable damage and expenses incurred as a direct result of the breach.
20. Termination of use and account deletion
A user may cease using the service and request deletion of their account in accordance with the mechanism existing in the application.
2TK may restrict or terminate access in the event of a breach of terms, abuse, a security risk, a legal requirement, or a need to protect users.

The use of personal information is subject to the 2TK Privacy Policy, which forms an integral part of these terms:

22. Updates to the terms
We may update these terms from time to time.
In the event of a material change, we will publish an appropriate notice or take notification measures as required as relevant.
23. Governing law
These terms and the use of the service shall be governed by the laws of the State of Israel.
Subject to any mandatory law applicable to the user, jurisdiction in connection with the service shall lie with the competent courts in the Tel Aviv-Jaffa District.
